The Shifting Interactions Between Copyrights and Trademarks in a Generative AI Age

Generative AI is changing the landscape across multiple sectors and bending what it means to be an author, writer, and artist. This, in turn, changes the relative importance of copyrights as to royalty calculations and consumer choice. In a time where "song designers" use prompts to create computer generated "music", and rely less on royalties and more on the song designer's personal branding, the stalwart humanities are becoming more akin to fashion which has long depended on branding serving as the basis for commercial success. This session will explore the blending, bending, and breaking of old revenue models as generative AI has arrived on the scene and what rightsholders should do to futureproof copyright-dependent industries.
